Case Study: Supporting a Lung Cancer Patient Exposed to Silica Dust

Background

Earlier this year, Peter, a 64-year-old man, was diagnosed with lung cancer that had already metastasised to his brain. His prognosis was just 3–6 months.

While Peter had a smoking history, he had also spent more than three decades working as a concrete truck driver, where he was regularly exposed to silica dust without proper protection. It was his cancer nurse who identified that his cancer could have an occupational cause and encouraged him to seek legal advice.

Collaboration

With Peter’s consent, Slater and Gordon worked in close partnership with his primary care team. His treating clinicians provided comprehensive details about his diagnosis, symptoms, and the profound impact of the illness on his day-to-day life. Importantly, Peter’s cancer nurses gave him the reassurance and support he needed to pursue a claim at such a vulnerable time in his life.

Outcome

As a result, Peter received a significant payment through Victoria’s statutory entitlements scheme. This eased the financial strain on his family and allowed him to make meaningful plans for their future. Beyond the financial outcome, Peter felt acknowledged and that his experiences had been taken seriously.
